Artificial intelligence acceptable use policy

  1. SCOPE

    1. This Artificial Intelligence Acceptable Use Policy (“Policy”) applies to customers’ use of all services offered by Trendstream Limited, Globalwebindex Inc. or their affiliates (“GWI”), or third party products, applications or functionality that interoperate with services offered by GWI, that incorporate or use artificial intelligence features, services, tools, and enhancements (collectively, “AI Services”). The terms of this Policy are in addition to the Main T&Cs and Product Specific Terms available at: https://www.gwi.com/legal which are incorporated by reference into this Policy.  

  2. CHANGES TO POLICY

    1. GWI may change this Policy by posting an updated version of the Policy at: https://www.gwi.com/legal  and such updates will be effective upon posting. 
  3. VIOLATIONS

    1. A violation of this Policy will be considered a material breach of the Agreement(s) governing your use of the Services. 

  4. DISALLOWED USAGE

    1. Except as otherwise expressly set out in your Order Form, you may not assign a user license or API access to a product, service, or application that utilizes artificial intelligence to operate autonomously, without requiring direct human intervention for its core function (“AI Tool”) or otherwise allowing any AI Tool to access the AI Services.

    2. You may not submit content to the AI Services (“Input”) that is harmful, threatening, defamatory, abusive, vulgar, obscene, irresponsible or offensive in any manner.

    3. You may not use any AI Services, nor allow your authorized users or any third party to use AI Services, for the following purposes:
           
      4.3.1 As part of an automated decision-making process with legal or similarly significant effects, unless you ensure that the final decision is made by a human being. In this case, you must take account of other factors beyond the content generated by the AI Services (“Output”) in making the final decision;
           
      4.3.2 to violate the privacy rights of others;
           
      4.3.3 Disseminate misleading, fraudulent or deceptive content that could lead to real-world harm;
          
      4.3.4 To exploit any of the vulnerabilities of a person (e.g., age, disability, or socio economic situation);     

      4.3.5 For social scoring or predictive profiling that would lead to discriminatory, unfair, biased, detrimental, unfavorable, or harmful treatment of certain persons or groups of persons;
          
       4.3.6 Deceive by misrepresenting content generated through AI Services as human generated or original content; or
          
      4.3.7 Engaging in plagiarism or academic dishonesty.
  5. NOTICES

    1. Outputs generated by AI are probabilistic. Outputs of AI Services should be evaluated for accuracy and appropriateness for your use case. 

    2. You and your authorized users are responsible for all decisions made, advice given, actions taken, and failures to take action based on your use of AI Services. 

    3. You are responsible for all your Inputs. You will ensure that your use of the AI Services, including the Input, complies with this Policy, our Terms and Conditions, and any sector specific regulation and industry best practice. 

    4. You acknowledge that Output may not be unique and that the AI Services may generate the same or similar Output for you or a third party.
