Anonymous RLD product specific terms

These terms were effective between 29th October 2024 and 19th October 2025. Except as otherwise set out in an active Order, if you used the Services during this period, these are the terms that apply to you. BY ENTERING INTO AN ORDER OR OTHER AGREEMENT WHICH INCORPORATES OR REFERENCES THIS AGREEMENT, BY CLICKING TO ACCEPT THIS AGREEMENT OR ACCESSING OR USING ANY GWI SERVICES, YOU ARE ACCEPTING ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. THIS AGREEMENT IS LEGALLY BINDING. IF YOU DO NOT AGREE TO THIS AGREEMENT, YOU MUST NOT USE ANY SERVICES.

1. SCOPE AND INTERPRETATION

   1. These Anonymous RLD Product Specific Terms (“RLD T&Cs”) supplement the Main T&Cs under which GWI provides its Anonymous RLD Services. Defined terms shall have the meaning set out below, in these Anonymous RLD Product Specific Terms. Any terms used but not defined below shall have the meaning as set out in the Main T&Cs.

      Anonymous RLD: means raw, anonymized respondent level data collected from respondents or participants in research studies, surveys, or similar data collection activity and associated Weighting Data for the applicable dataset (as set out in your Order);

      Anonymous RLD Services: shall mean (a) access and use of the Wave(s) of Anonymous RLD; (b) Trial Services; and/or (c) such other services as GWI may deem appropriate to grant from time to time, in whole or part as set out in your Order;

      Initial Subscription Period: means the initial subscription period set out in your Order;

      Marketplace: the third party database and/or marketplace that facilitates access to the Anonymous RLD Services, use of which shall be subject to the additional terms of your agreement directly with the marketplace provider;

      Scope: the RLD permitted use and commercial scope as set out in your Order;

      Wave: the dataset(s) as set out in your Order in the “scope’ section only; and

      Weighting Data: data provided on a per respondent level to illustrate the universe portion (as defined by GWI) each respondent represents for the applicable dataset (as set out in your Order).

2. SUBSCRIPTION PERIOD

   1. Except where you are accessing Trial Services or otherwise set out in your Order, the Subscription Period for Anonymous RLD Services shall commence on the date set out in your Order and will continue for the Initial Subscription Period, and, thereafter, shall automatically renew for subsequent periods of equal duration (each a “Renewal Period”), unless either party gives the other written notice of termination at least thirty (30) days prior to expiration of the applicable Initial Subscription Period or Renewal Period.

3. YOUR OBLIGATIONS

   1. You shall not alter the Weighting Data or apply any alternative ratios or algorithms to the Anonymous RLD without our written consent. GWI reserves the right to charge for any additional support services should changes be required. This clause 3 shall survive termination of the Agreement. 
4. MARKETPLACE ACCESS
    
   1. Where you access the Anonymous RLD Services via a Marketplace, you acknowledge that the Marketplace is completely independent of us, and that the Marketplace has no authority to enter into any contract, grant any right or provide any promise, guarantee or commitment on our behalf. Any terms and conditions governing transactions and/or arrangements solely between you and the Marketplace shall not form part of this Agreement.
5. PERSONAL DATA
   
   
   1. In this clause 5, the following terms shall have the meanings given to them in the Data Protection Legislation: controller, data subject, personal data and process and processed shall be construed accordingly.
      
      
   2. Anonymous RLD does not contain any personal data and GWI does not process any personal data as a processor for you.  You acknowledge and agree that in the course of providing the Anonymous RLD Services, GWI may process limited personal data as a controller such as business administration data, including login details and work email addresses in accordance with our privacy policy. For the purposes of CCPA, GWI shall not use, sell, rent, transfer, distribute, or otherwise disclose or make available for sale the personal information for our own purposes or for the benefit of any third party.
